Bicycle Accidents

Bicycle accidents with motor vehicles continue to occur in a variety of circumstances and often involve recreational adult riders. Collisions which involve children tend to occur on residential streets whereas those concerning adult riders generally occur in the flow of traffic on municipal streets.

Connecticut  injury law takes into account both the operative roadway rights of way and the status of the individual bicyclist. For example, a child rider is held to a more relaxed standard suitable to the age and circumstances of the involved minor in terms of  evaluating their degree of comparative negligence, if any, in bringing about the accident.

A bicyclist is entitled to the same protections, privileges and rights of way as a motor vehicle operator and prudence dictates that the latter is somewhat deferential in many instances because of the inequality of the situation. In short, the Bicyclist loses in any accident and the injuries may be serious if not life threatening. This is largely due to the physics of the crash and the lack of steel frame protection for the rider.  On an annual basis, the percentage of driving fatalities, brain injuries, paralysis and fractures requiring surgery stemming from such accidents is astounding. In Connecticut, we have endured a number of such tragedies. Occasionally, a defective piece of equipment on the Bicycle is a factor in bringing about the accident, though more often it is due to operator error.

If you have been harmed in such an event, we will aggressively and tirelessly pursue your case. Getting legal help early is perhaps the single most important thing you can do once you have secured high quality medical and rehabilitative care. Strict Statute of Limitation periods apply and there is often much advance preparation and additional investigation which precedes the filing of a lawsuit. We pursue these types of cases, when justified, strictly on a contingency fee basis and advance all  costs of investigation which you are not responsible for  unless we recover a  Judgment or settlement on your behalf.
