What is an injury lawsuit, and when is it necessary to go to trial?

An injury lawsuit is a legal action taken by an individual who has suffered an injury for which someone else was at fault. It involves a formal judicial proceeding in which testimony may be offered and, if a settlement cannot be reached, it may be necessary to go to trial. In the vast majority of cases, injury claims are settled before reaching trial.

However, in some cases, it may not be possible to get fair value for a claim through a settlement. For example, the full impact of an injury on an individual's life may not be entirely clear to disinterested insurance adjusters viewing the injury's consequences as little more than a simple mathematical formula. In these situations, it may be necessary to go to trial in order for injury victims to get the justice they deserve.

When an injury lawsuit is taken to trial, a jury is able to more comprehensively understand the toll that an injury may take on the victim's life. While going to trial can be a more time-intensive process, the compensation that injury victims may be able to obtain though this process may make the additional effort worth it.
